Payment of fees under RTI Act by Indian Postal Order

                         Subject:- Payment of fee under the RTI Act by lndian Postal Order.
The undersigned is directed to say that the Right to information (Regulation of
Fee and Cost) Rules, 2005 provide that a person seeking information under the RTI
Act, 1005 can make payment of fee for obtdning information by cash or demand
draft or banker's cheque or lndian Postal Order. It has been brought to the notice
of this Department that some public authorities do not accept fee through the
lndian Postal Orders.
2. As stated above, one of the approved modes of payment of fee under the
Rules is through lndian Postal Order. Refusal to accept fee through the IPO may be
treated as refusal to accept the application. It may result into imposition of penalty
by the Central Information Commission on the'concerned Central Publk Information
Officer under Section 20 of the Act. AH the public authorities should, therefore,
ensure that payment of fee by IPO is not denied.

                  Subject: Cadre Allocation Policy for the All lndia Services - IAS /IPS/IFS - Reg.

              The undersigned is directed to refer to the Cadre Allocation Policy issued vide
 O.M. No. 13011/22/2005-AIS-I dated loth~ p r i l ,2 008 and to say that the Government
has since reviewed the Policy. It has been decided by the competent authority to amend the Para 9 of the said Policy. The existing para 9 of the Cadre Allocation Policy and the amended para 9 of the Cadre Allocation Policy are given below:-
Existing Para 9 of Cadre Allocation PolicyA reserved category candidate selected on general standards shall be eligible for allocation against the available insider unreserved vacancy as per his merit and preference. But if he cannot be allocated against such vacancy, for he is lower in rank as compared with other general category candidates, he shall be
considered for allocation as per his merit and preference against the available insider vacancy of his category and, in case found eligible, adjusted by exchanging insider vacancy in his category into insider
UR vacancy and outsider UR vacancy into outsider reserved vacancy of his category. this is to ensure that such candidates is not placed at disadvantageous position vis-a- vis other candidates of his category in
the merit list below him.


Amended Para 9 of Cadre Allocation Policy

Notwithstanding what has been said above a reserved category candidate selected on general standards shall be eligible for llocation against the available unreserved vacancy as per his merit and preference. But if he cannot be allocated against such vacancy, for he is lower in rank compared with other general
category candidates, he shall be considered for allocation as per his merit and preference against the available
vacancy of his category.
2. Revised Cadre Allocation Policy will be implemented w.e.f. CSE-2009.

THE ALLOWANCES TO BE RAISED 25%

Dearness Allowance has been raised to 51% with effect from 01-01-2011. As the Government accepted the 6CPC recommendations, when D.A reaches 50%, the allowances which are compensatory in nature also should be raised by 25%. There are many allowances and advances are recommended to be raised 25% .

NFIR insisted that 37 Allowances and Advances have to be increased and also demanded the railway Ministry to issue necessary orders without any delay. Many of viewers keep on asking that when will the allowance be raised? As the D.A reaches 50% in January 2011 itself, subsequently all the allowance should witness the hike from January 2011. If so how the children education allowance will be calculated for the remaining period of the academic year? The advances, which have been issued from January 2011 to till date, can be raised? Necessary Clarifications are expected from competent authorities very soon

GRANT OF PENSION TO CHILDLESS WIDOW OF A DECEASED EMPLOYEE AFTER HER REMARRIAGE

OFFICE MEMORANDUM

Subject: Grant of family pension to childless widow of a deceased Central Government employee after her remarriage – Clarification -reg.

   A reference is invited to the Department of Pension & Pensioners’ Welfare’s O.M.No. 38/37/08-P&PW(A) dt. 2.9.2008 whereby provisions regulating pension/family pension/gratuity/commutation of pension/disability pension/ex-gratia lump sum compensation, etc. were revised consequent upon implementation of Government’s decision on the recommendations of 6th CPC.

   2. As per the provisions of para 8.6 of the ibid O.M., the childless widow of a deceased Government employee shall continue to be paid family pension even after her remarriage subject to the condition that the family pension shall cease once her independent income from all other sources becomes equal to or higher than the minimum prescribed for family pension in the Central Government.

   3. References/Representations have been received in this Department from various quarters raising therein doubts that the provisions of this Department’s O.M. dt. 2.9.2008 do not adequately take care of cases wherein death of the employee took place prior to 1.1.2006 and the childless widow of the deceased employee got remarried before/on or after 1.1.2006.

   4. The issue has been examined in this Department in consultation with Department of Expenditure. It is hereby clarified that the childless widow of a deceased Central Government employee who had expired before 1.1.2006, shall be eligible for family pension in the light of 6th CPC’s recommendations irrespective of the fact that the remarriage of the widow had taken place prior to/on or after 1.1.2006. The financial benefits in such cases, however, will accrue from 1.1.2006. This, however, would be subject to the fulfillment of certain conditions laid down therein, including the income criterion that the income of the widow from all sources does not become equal to or higher than the minimum prescribed for family pension in the Central Government.

   5. This issues with the concurrence of Department of Expenditure, Ministry of Finance vide their U.O. No.64/EV/2011 dt. 11 3.2011.

   6. This order, in so far as their applicability relates to the employees of Indian Audit & Accounts Department, is being issued in consultation with the Comptroller and Auditor General of India vide their U.O. No.50 -Audit(Rules/ 14-2010 dt. 31.3.2011…
