The Government had appointed a three member Committee of Experts to examine and suggest measures to expedite the process involved in Disciplinary/Vigilance Proceedings. In its Report, the Committee has recommended that a time limit of two months may be prescribed for completion of minor penalty disciplinary inquiries and 12 months for major penalty disciplinary inquiries.

The department has powers to issue the charge sheet even on the last day of the service of an employee.Now you will have to defend yourself in the inquiry and prove that the charges are false.If you want any guidance, you may send me the charge sheet on my email i.d.given on the blog. Since the inquiry is initiated now , it will be completed after your retirement. You will be entitled for provisional pension till finalization of the proceedings. No gratuity will be payable till that time.If you are held guilty, your pension full or part of it is liable to be withdrawn/wihtheld for permanantly or for specific period. The departmental authorities will have to conduct the inquiry as provided in the C.C.S.(C.C.A.)Rules.

Sir I have suspended on 17.03.2010 and reinstated into service on 17.09.2010. but till today no chargesheet/notice has been issued and the departmental enquiry is not yet started, it is still under pending. Sir may i eligible for promotion or not? if not then what is the time limit to issue a chargesheet/notice? Plz help sir

There has been number of false complaints against me from the students of my institute for which enquiry also has been conducted before one year. So far no report or status regarding the enquiry has been given. When asked they reply that no enquiry has been conducted hiding the enquiry process itself. However I have the copy of enquiry documents. Here what shall I do?
Was it a preliminary inquiry or regular departmental iquiry held against you ?It appears that a preliminary investigation/ inquiry is done to find out whether there is prima facie truth in the allegations mentioned in the complaint to decide whether it warrants a regular departmental inquiry against you.Since no regular inquiry has been started against you so far, it appears that the authorities have not found the truth in the complaints.
